PartyNOW hereby grants you access to (“the App”) and invites you to use the services offered here.Definitions and key termsTo help explain things as clearly as possible in this EULA, every time any of these terms are referenced, they are strictly defined as:• Company: when this policy mentions “Company,” “we,” “us,” or “our,” it refers to PartyNOW, that is responsible for your use of the App.
• Service: refers to the service provided by PartyNOW as described in the App.
• Third-party service: refers to analytics and support tools such as Google Analytics for Firebase, Firebase Crashlytics, and Mixpanel.
• App/Application: PartyNOW app, refers to the SOFTWARE PRODUCT identified above.
• You: a person or entity that uses the App.IntroductionThis End User License Agreement (the “Agreement”) is a binding agreement between you (“End User”, “you” or “your”) and PartyNOW (“Company”, “we”, “us” or “our”). This Agreement governs your use of the Application and the relationship between you and us.By downloading, installing, accessing, or using the App you:
(a) confirm that you are at least 18 years old;
(b) acknowledge that you have read and understand this Agreement;
(c) represent that you are able to enter into a binding agreement; and
(d) accept and agree to be legally bound by its terms.If you do not agree to these terms, do not download, install, access, or use the App. If you have already downloaded it, delete it from your device.The Application is licensed, not sold, to you for use strictly in accordance with this Agreement.LicenseSubject to the terms of this Agreement, PartyNOW grants you a limited, non-exclusive, revocable, and non-transferable license to:
(a) download, install, and use the Application on a personal device;
(b) access and use the features and content made available within the Application;
(c) receive updates and improvements that may be provided from time to time.Payments and SubscriptionsThe Application offers paid subscriptions that provide access to all features and content, while free access may be limited.
Subscriptions are available on a recurring basis (weekly, monthly, or annual) and automatically renew unless canceled.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You may cancel your subscription at any time through your App Store account settings to stop future renewals.
All payments are processed through the App Store and are subject to its terms and conditions. The Company does not collect or store any payment information.
Prices may change at any time at the sole discretion of the Company. Any changes will not affect your current subscription period but may apply upon renewal.
All purchases are final, except where required by applicable law.
Refunds are handled by Apple in accordance with App Store policies.RestrictionsYou agree not to, and you will not permit others to:• license, sell, rent, lease, assign, distribute, or otherwise commercially exploit the Application;
• modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application;
• remove, alter, or obscure any proprietary notices of the Company or its licensors;
• use the Application in any unlawful, harmful, or abusive manner.AI-Generated ContentThe Application may include content generated with the use of artificial intelligence. Such content is provided for informational or entertainment purposes only and may not always be accurate, complete, or appropriate.
The Company makes no guarantees regarding the quality, reliability, or suitability of AI-generated content. You acknowledge that such content may contain errors or unexpected results and that interpretation of such content may vary between users.
If you encounter content that you believe is inappropriate, offensive, misleading, or incorrect, you may report it directly through the Application. The Company reserves the right to review, modify, or remove any content at its sole discretion.Acceptable Use (18+ Application)The Application is intended strictly for individuals who are 18 years of age or older. By using the Application, you confirm that you meet this requirement.
You agree not to use the Application to create, share, or engage with content that is illegal, abusive, discriminatory, harmful, or otherwise inappropriate.
The Company reserves the right to suspend or terminate access to the Application if these rules are violated.Intellectual PropertyAll intellectual property rights, including copyrights, trademarks, and other proprietary rights, in and to the Application remain the exclusive property of PartyNOW or its licensors.
Nothing in this Agreement grants you ownership of the Application or any related intellectual property. You are granted only a limited right to use the Application under the terms of this Agreement.Your SuggestionsAny feedback, comments, ideas, or suggestions (“Suggestions”) provided by you regarding the Application shall become the sole property of the Company.
The Company may use such Suggestions for any purpose without acknowledgment or compensation to you.Modifications to ApplicationPartyNOW reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.Updates to ApplicationThe Company may provide updates, enhancements, or improvements to the Application, including bug fixes and new features (“Updates”).
Updates may modify or remove certain features or functionalities. You agree that all Updates are part of the Application and subject to this Agreement. The Company has no obligation to provide any Updates or maintain specific features.Term and TerminationThis Agreement shall remain in effect until terminated by you or the Company.
The Company may, at its sole discretion, suspend or terminate this Agreement at any time, with or without notice, if you fail to comply with its terms.
Upon termination, you must cease all use of the Application and delete all copies from your device.IndemnificationTo the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PartyNOW and its affiliates from any claims, damages, or expenses arising from your use of the Application, your violation of this Agreement, or your violation of any applicable law.No WarrantiesThe Application is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
The Company does not guarantee that the Application will be uninterrupted, error-free, or that any defects will be corrected.Limitation of LiabilityTo the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Application.
This includes, but is not limited to, loss of data, loss of profits, or business interruption.Dispute ResolutionBefore initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. If the dispute is not resolved within 30 days, either party may pursue formal resolution. To the maximum extent permitted by applicable law, you agree that any unresolved dispute shall be settled through binding arbitration rather than in court, except for claims that may be brought in small claims court. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.Governing Law and JurisdictionThis Agreement shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any disputes arising from or relating to this Agreement or your use of the Application shall be subject to the exclusive jurisdiction of the courts located in Warsaw, Poland. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.PrivacyYour use of the Application is also governed by our Privacy Policy.Changes to this AgreementThe Company reserves the right to modify this Agreement at any time.
